This agreement is about looking after Country and looking after each other. It’s about making a safe working environment for everyone. This is required by law. Yugunga-Nya Common Law Holders who wish to participate in YN PBC Activities must sign the YN PBC Activities Agreement (Code of Conduct). Policies and procedures to enforce the Code of Conduct will be developed.

 

Yugunga-Nya Common Law Holders are advised that Unacceptable Behaviour will result in either their removal from the Activity or the Activity being cancelled. Unacceptable Behaviour makes someone feel physically unsafe, emotionally unsafe or disrespected (professionally or personally). Examples include (but are not limited to):


  • Swearing aggressively or rudely
  • Yelling
  • Sexual or physical harassment or intimidation
  • Verbal, physical or written threats
  • Personal or professional insults
  • Being on drugs or alcohol
  • Cultural threats

Meeting Code Of Conduct

Yugunga-Nya Native Title Aboriginal Corporation RNTBC holds meetings and forums to provide an avenue for members and stakeholders to share ideas, express concerns and participate in governance processes.

To ensure the safety and well-being of everyone present at a meeting and allow for orderly proceedings, all Members, guests, and staff are all subject to the Code of Conduct:

  • All meetings are smoke-free, alcohol-free and drug-free events. A drug and alcohol screen may be requested if people are exhibiting symptoms of intoxication. Anyone returning a positive result will be asked to leave the meeting.
  • Any differences of opinion will be addressed through discussions, voting and consensus. 
  • Shouting, swearing, insulting, continuous interruptions, or verbally or physically aggressive behaviour will not be tolerated.
  • No weapons are permitted in meetings.
  • Elders and children may be present, please be considerate of them during meetings.

Failure to comply with the code of conduct will result in a 3-step disciplinary action, with two warnings and a final direction to be removed from the meeting. If a person is removed from a meeting, the Chairperson shall inform the person that their entitlements and rights as a member of YN PBC risk being removed in accordance with the Rule Book clause 5.6.3 Cancelling Membership if a Member misbehaves “in a way that significantly interfered with the operation of the Corporation or of Corporation meetings”.

Member Responsibilities

 

Each Member has the following responsibilities:

 

  1. To comply with the Corporations (Aboriginal and Torres Strait Islander) Act and the Rule Book;
  2. To notify the Corporation of any change of address within 28 days;
  3. To comply with any code of conduct adopted by the Corporation;
  4. To treat other Members, the Elders Council, and the Directors with respect and dignity;
  5. To not behave in a way that significantly interferes with the operation of the Corporation or of Corporation meetings;
  6. Not to make improper use of information or opportunities received because of their position as Members or Directors; and
  7. Not to make any public statement on behalf of the Corporation unless authorised by the Directors.
